Terms of Use

1. Agreement to these terms

These Terms of Use (“Terms”) are an agreement between you and BZOTech (“we”, “us”) for the Plantiqo mobile application (“Plantiqo” or “the app”) and this website. By downloading or using Plantiqo you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

If you downloaded Plantiqo from the Apple App Store, these Terms also include the Apple-specific terms below; where these Terms do not address something, Apple’s Standard End User License Agreement applies.

2. Eligibility

You must be at least 18 years old to use Plantiqo. By using the app you confirm that you meet this requirement and can form a binding contract.

3. License to use the app

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Plantiqo on devices you own or control, for your personal, non-commercial use, in line with these Terms and the rules of the store you downloaded it from.

You may not: copy, modify or create derivative works of the app; reverse engineer or decompile it except where the law allows; circumvent usage limits, App Check or other security measures; use the built-in AI for automated or bulk requests or to build a competing service; or use the app for any unlawful purpose.

4. AI suggestions are guidance only

Plant identification, health checks, chat answers, garden briefs, voice interpretation and weather tips are generated by artificial intelligence (Google Gemini) and automated rules. They may be incomplete or wrong.

• Results are suggestions, not a definitive identification or diagnosis. Always check your plant and its conditions before acting.
• Information about toxicity, edibility or pet safety must never be relied on. If a person or animal may have ingested a plant, contact a doctor, veterinarian or poison control center immediately.
• Do not use Plantiqo for medical, veterinary, agricultural-commercial or safety-critical decisions.
• Voice and AI actions are only saved after you confirm them – please review them before confirming.

You can report any AI answer from within the app. We review reports to improve safety and quality.

5. Your content

You own the photos, notes, recordings and other content you create in Plantiqo (“Your Content”). Your Content is stored on your device. When you use AI, weather or backup features, you allow the app to send the relevant content to the service providers described in the Privacy Policy, solely to provide that feature.

You are responsible for Your Content and confirm you have the right to use it. Do not upload content that is illegal, infringes others’ rights, or contains other people’s personal information without their permission. Because your data is stored on your device, you are responsible for keeping backups; we cannot recover data that was deleted or lost with a device.

6. AI usage limits and your own API key

The built-in Plantiqo AI includes a daily allowance of AI requests: currently 10 per day on the free plan (plus optional bonus requests from rewarded ads) and 100 per day with AI Plus. Limits are reset daily and may be adjusted to keep the service fair and available. Care features that do not use AI are never blocked by these limits.

If you connect your own Gemini API key, requests are made under your Google account, you are responsible for complying with Google’s terms for the Gemini API and for any charges Google bills to you, and our daily limits do not apply. Keep your key private.

7. AI Plus subscriptions

AI Plus is an optional, auto-renewing subscription offered monthly (from USD 3.99) or yearly (from USD 31.99). The exact price in your currency, including applicable taxes, is shown in the app before you buy.

• Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• The subscription renews automatically for the same period and price unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Cancelling stops future renewals; you keep AI Plus until the end of the paid period.
• If a free trial or introductory offer is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
• Refunds are handled by Apple or Google under their policies. See Support for links.
• If we change the price, the store will notify you in advance and, where required, ask for your consent.

Use “Restore purchases” in the app to restore an active subscription on a new device using the same store account.

8. Advertising

The free plan is supported by ads. Ads are provided by third parties, and we are not responsible for the content of ads or the products and websites they promote. Your advertising choices are described in the Privacy Policy.

9. Third-party services

Plantiqo relies on third-party services, including Google (Gemini, Firebase, Google Sign-In and Drive), Appodeal, Open-Meteo and the app stores. Your use of those services may be subject to their own terms. We are not responsible for their availability or content. Weather data is provided by Open-Meteo under the CC BY 4.0 license.

10. Intellectual property

Plantiqo, its name, logo, design, text, graphics and software are owned by BZOTech or its licensors and are protected by intellectual property laws. Except for the license granted above, no rights are transferred to you.

If you send us feedback or suggestions, we may use them without any obligation to you.

11. Disclaimer of warranties

To the maximum extent permitted by law, Plantiqo is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the app will be uninterrupted or error-free, that AI results will be accurate, or that your plants will thrive. Nothing in these Terms limits rights you have as a consumer that cannot be limited by law.

12. Limitation of liability

To the maximum extent permitted by law, BZOTech will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, plants, property, profits or goodwill, arising from or related to your use of Plantiqo. Our total liability for any claim relating to the app is limited to the amount you paid us for Plantiqo in the 12 months before the claim, or USD 10 if you paid nothing.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

13. Termination

You may stop using Plantiqo at any time by deleting the app. We may suspend or end your access to online features (such as the built-in AI) if you breach these Terms or misuse the service. Sections that by their nature should survive – including Your Content, disclaimers, limitation of liability and governing law – survive termination.

14. Changes to the app and these Terms

We may update Plantiqo and these Terms from time to time, for example to add features or reflect legal requirements. We will post the updated Terms on this page with a new effective date and, for material changes, notify you in the app. Continuing to use Plantiqo after changes take effect means you accept the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of the country in which BZOTech is established, without regard to conflict-of-law rules. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and you may bring proceedings in your local courts. Before starting any formal dispute, please contact us so we can try to resolve the issue informally.

16. Apple App Store additional terms

If you downloaded Plantiqo from the Apple App Store, you acknowledge that:

• These Terms are between you and BZOTech only, not Apple. BZOTech, not Apple, is solely responsible for the app and its content.
• Your license is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• BZOTech, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer protection claims.
• In the event of a third-party claim that the app infringes intellectual property rights, BZOTech, not Apple, is responsible for the investigation, defense, settlement and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Google Play additional terms

If you downloaded Plantiqo from Google Play, you also agree to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the app.
